SAY NO TO RESERVATION AND BE A HERO IN INDIA

When India became free, she needed a new Constitution to replace the old Government of India
Act of 1935 which was a tool used by the British Government. This new Constitution was
drafted by Dr. B.R. Ambedkar as Chairman with the help of Mr. Surendra Nath Mukherjee and
Mr. B.N. Rao. (Mr. Prem Behari Narain Raizada was the Calligrapher of this new
Constitution.) The new Constituent Assembly of India adopted the new Constitution on
November 26, 1949 which came into effect on January 26 of 1950. However, this constitution
did not bring every citizen, Hindu, Muslim or of any other religion, under one umbrella. Since it
was supposed to be “Hindustan”, this Committee did not touch any issue about Muslim
population. They might have, I assume, thought that majority of Muslim will move to Pakistan,
so remaining Muslim population will abide by the new Constitution, also they could not think
that Jawaharlal Nehru would suddenly adopt “secularism” in India. Many Congress leaders
including Sardar Ballav Bhai Patel did not welcome this policy of Nehru. Only whole hearted
support for Nehru’s secularism came from the great Gandhi, the father of nation. Gandhi and
Nehru together did a real damage to the rights of Hindus of India.
The articles 15, 16 & 17 of Indian Constitution grant significant privileges to Scheduled Castes
(SC) and Scheduled Tribes (ST), and other Backward Class (OBC) including reservation in
government jobs and educational institutions, special provisions for their socio-economic
development, and protection from social injustice through articles like 15(4), 16(4), and 330,
ensuring affirmative action to uplift historically marginalized communities.
It is praiseworthy to see that the writers of the Constitution put a plan to upbring the under
developed and under privileged who were subjected to discrimination on the ground of caste,
religion, sex, race etc. to bring them to the level where every citizen to the society of India.
If you look into the principle by which India became free and divided, it clearly mandated a land
for Hindus and a land for Muslims. Muslims were happy to get Pakistan as their country while
India was for the Hindus. However, a game played by Nehru and Congress Party probably put
India into the harm’s way for the future of the country when Nehru made sure that Muslim
Personal Law (Shariat) Application of 1937 guides the living of Muslims who decided to live in
India. This law deals with Marriage, Succession. Inheritance, and Charities among Muslims and
other aspects of a Muslim’s life essentially governing of family relations within the Islamic faith.
By this act of denial of rights of Hindus in their own Hindustan, instead of one country one rule,
it became one country with two rules one for the Hindus and one for the Muslims. This was the
first nail put into coffin of the dreams of Hindustan by PM Nehru and the final nail was put by
his daughter Prime Minister Indira Gandhi in 1976 when she did the 42 nd amendment during the
emergency. This act may not be an act of betrayal for the Hindus but it was definitely an act of
denial of the rights for a Hindu Country, consequently it started a new era of appeasing the
Muslims for votes for the Congress Party. This Muslim adulation of the Congress Party during
the earlier days of freedom sowed the seed of denying the rights of Hindus and arrogance and
domination of Muslims started to sail in the land of Hindustan. Unfortunately, regional political
parties started the same game of appeasing the Muslims just to get their votes and consequently
the country is in the brink of peril, its prime example is West Bengal, where Hindu’s temples are
being demolished on a regular basis, in some Muslim dominated areas Hindu’s rights for temple,
Durga or Sarswati Pooja are being denied by the Muslims and the administration often ignores
these incidents. In my estimation, West Bengal will become a Muslim majority state by the end
of the year 2050. Bangladeshi infiltration is making West Bengal a worse place for Hindus to live
with religious freedom. If this infiltration is not stopped, West Bengal will become a second
Bangladesh where oppression of Hindus will continue.
The Constitution of India has rewarded the schedule castes(SC), schedule tribes(ST) and other
backward classes(OBC) with reservation to prioritize the social development for these classes of
peoples in the country. The reservation policy provides 15% for Scheduled Caste, 7.5% for
Scheduled Tribes, and 27 % for Other Backward Classes. Data indicates steady appointments
across these categories each year. In central-government funded higher educational institutions ,
22.5% available seats are reserved Scheduled Caste (SC) and Scheduled Tribes (ST) Students
(7.5% for ST and 15% for SCs).
This reservation percentage has been raised to 49.5% by including an additional 27% reservation
for OBCs.” People belonging to Schedule Caste and Schedule Tribe have done very well under
the reservation provision. They are all over the in the state or central government as a successful
candidate in UPSC Examinations like IAS,IPS, IRS etc. Eventually they have risen to the status
of non-scheduled population. They are taking this advantage for generations even when they do
not need it. This provision should be amended and should end after the second generation of the
recipient. From third generation they should compete with general population. One good thing,
the people included in reserve category Schedule Caste and Schedule Tribe have used this
benefit very well and they have taken the advantage of these and educate themselves to a great
degree while OBC included Muslims failed to take the advantage of it properly. Muslims are
smart people yet they opt for Madrasa where students are not proper education for science is not
provided, Muslims are intelligent, yet they are begging to include them in OBC category of
Reservation just to get the advantage of the generosity of the system.
The Muslims have grown in population by a large number in India. They should not be treated as
minority any more. Their eligibility to be included in OBC must be stopped and they should be
treated like any other citizen.
This reservation has a savaging effect in the morale of regular population because for ancestral
progress the present generation is being deprived of the entrance in government entities and
educational institutions because 49.5 per cent of these positions are going to the reserved
population. This system has a potential for corruption because non-reserved population will also
try to include their names by corrupt means like bribing etc., the other ominous effect may come
from this category that they will try to accumulate wealth by any means to make sure that their
next generations get a comfortable life. That is why these privileged categories must be
monitored for any inconsistent income or wealth accumulation, as a result this may put a lid on
this corrupt practice by these groups.
The articles 15, 16 and 17 of Indian Constitution has granted significant privileges to Scheduled
Castes (SC) and Scheduled Tribes (ST), and other Backward Class (OBC) including reservation
in government jobs and educational institutions, after 75 years of freedom time has come to curb
these benefits and distribute this quota to regular population. These articles15, 16 and 17 must be
eliminated or be amended that these will not be effective from 3 rd generation from the first
recipient of such benefits. These recipients have probably delivered a lower quality of
intelligence because of these quotas and have deprived the services of the best for country.
While the common Muslim children were sent to Madrasas, the children of the Muslim Leaders
attended the schools or colleges where every other community sent their children for education.
It is well known that the educational quality in a traditional Madrasa is not directly equal to that
of a regular school in India, because madrasas primarily focus on religious studies rather than
broad curriculum. Unfortunately, Muslim leaders do not discourage schooling in Madrasa while
they send their children to regular or private schools for education.
Even the Imams are not for progressive education for the mass, they are busy to put their own
agenda of conversion, Education is, never a priority for them. This is a sad reality that Muslims
are being betrayed by their own Leaders in India.
In modern literature many castes under Scheduled Castes category are sometimes referred to as
“Dalit”, “Harijan” , “Adivasi”, etc. Does not matter how you call them they are under Reserved
category and they deserve to get the benefits given by the Constitution of India.
Since the Muslims are governed by the “Muslim Personal Law (Shariat) Application act, 1937
India has become a country having two separate sets of law which will have separate controls of
citizens of the country one for the Hindus and one for the Muslims.
As this law deals with marriage, succession, inheritance and charities among Muslims, then any
crimes committed by Muslims will be tried by the Shariat Law. The Government should not
concede to this kind of dual system in one country, this dual system may reduce the pace
progress of India, while one section of population will lag behind the other, probably the Hindus.
Unfortunately, neither the Muslim Leaders nor the Muslim Appeasers ever tried to inculcate real
education among the Muslim population. The Muslim leaders must teach their people the
importance of the mutual respect and tolerance.
This reservation affects the morale of regular population because for ancestral progress the
present generation is being deprived of the entrance in government entities and educational
institutions because 49.5 per cent of these positions are going to the reserved population. This
system has a potential for corruption because non-reserved population will also try to include
their names by corrupt means like bribing etc., the other ominous effect may come from this
category that they will try to accumulate wealth by any means to make sure that their next
generations get a comfortable life. That is why this privileged categorization must not go beyond
the second generation. Time has come to stop this reservation from third generation because
eventually this will create reverse discrimination for the regular population.
Now, the time has come for the recipients of these articles 15, 16 and 17 voluntarily come
forward and say “NO” to Reservation and join the citizenry to become a proud citizen of India.
